US Judge Mandates Release of Kilmar Abrego Garcia from ICE Detention

Courtroom proceedings

A federal judge has ordered the prompt release of Kilmar Abrego Garcia from detention by ICE, concluding his ongoing detainment is without lawful basis.

"Since Abrego Garcia's release after wrongful imprisonment in El Salvador, he has been re-detained, again without lawful authority," Judge Paula Xinis wrote in her ruling.

The situation originates in a erroneous deportation to El Salvador in March, which US authorities later admitted was an mistake. Following his repatriation to the United States to face human smuggling charges, he was detained in federal custody.

In her decision, the court noted that the government lacks a valid removal order, which effectively blocks them from deporting Mr. Abrego Garcia "at this time."

Background of the Legal Challenge

The court proceedings center on disputed assertions. While the former administration contends that Abrego Garcia is a member of the MS-13 gang, he vehemently denies this allegation.

He has also entered a not guilty plea to the conspiracy charges, which are part of a ongoing criminal case in the state of Tennessee.

Terms of Freedom

The court, who was hearing his challenge to deportation in a Maryland district court, ruled that he must now comply with the conditions of his bond from custody in Tennessee. This decision shifts his monitoring to the Tennessee court.

This decision represents a significant turn in a complicated immigration case featuring allegations of wrongful detention and contested gang associations.
